Fair Use Policy
1. Purpose
Legion Gear builds bags to withstand daily use on Australian mining, construction, and trade worksites. This policy sets out what our products are designed for, what they are not designed for, and how we determine whether damage or failure is covered under our Warranty Policy.
This document works together with our Warranty Policy, which sets out warranty periods and the claims process. This policy governs what counts as intended use and fair wear, and what does not.
2. Intended Use
Legion Gear tool bags and cool bags are designed for:
- Carrying hand tools, small equipment, and accessories commonly used on mining, construction, and trade sites, within each product's stated weight capacity
- Transporting and preserving food and beverages under typical job-site conditions (cool bags)
- Daily use in outdoor, on-site conditions, including dust, dirt, rain, and UV exposure
Each product's rated weight capacity is stated on its product page and on the care label attached to the item. Where a specific limit isn't stated, treat the product as intended for hand tools and small equipment only, not heavy machinery or bulk materials.
3. Uses Outside Design Intent
Our bags are not designed for, and are not covered under warranty when used for:
- Carrying loads beyond the product's stated weight capacity
- Storing or transporting hazardous, corrosive, or flammable materials
- Use as a lifting sling, tie-down, towing strap, or restraint
- Direct contact with sharp tools or machinery without the use of protective inserts
- Exposure to corrosive chemicals, solvents, fuel, or high-temperature surfaces
4. What We Look for When Assessing a Claim
When assessing whether damage or failure is covered under warranty, we look at physical evidence on the product itself — not a description of how it was used or cared for. This keeps the assessment consistent and fair for every customer.
Indicators consistent with a covered manufacturing defect:
- A stitched seam that opens with no sign of overloading, stress distortion, or damage to the surrounding panel
- A zip slider or coil that fails to run or mesh correctly, with no grit, corrosion, fabric damage, or forcing visible at the point of failure
- Hardware (buckles, clips, D-rings) that fractures or fails under normal, within-capacity loading
- Fabric or coating that delaminates, splits, or fails without external cause
Indicators consistent with fair wear, misuse, or damage — not covered under warranty:
- Overloading beyond stated weight capacity, including stress marks, distorted panel shape, or torn stitching consistent with overloading
- Holes, cuts, abrasion, or scuffing caused by tools, equipment, or other contents carried inside the bag
- Grit, dirt, or debris packed into a zip coil or slider at the point of failure
- Corrosion, rust staining, or pitting on zips or hardware
- Mould, mildew, or odour consistent with the product being stored wet or unclean
- Fabric distorted, torn, or a zip forced/misaligned consistent with being closed over an overloaded or overpacked bag
- Damage from corrosive chemicals, solvents, fuel, or high-temperature surfaces
- Cuts, punctures, burns, or intentional modification of the product
- Use of the product as a lifting sling, tie-down, towing strap, or restraint
- Normal aesthetic wear — fading, staining, scuffing, or colour change from UV or general use
- Damage arising after any repair or alteration carried out by the customer or a third party
Where a claim shows a combination of a component failure and one or more of the fair-wear or misuse indicators above, it will be assessed as excluded under this policy rather than as a covered defect.

Warranty periods, the claims process, required evidence, and remedies are set out in full in our Warranty Policy. In short: email Info@legiongear.com.au with your proof of purchase and clear photos of the failure point, and we'll assess it against the criteria above.
6. Australian Consumer Law
This policy does not limit or exclude your rights under the Australian Consumer Law or under our Warranty Policy. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law, and you remain entitled to a replacement, repair, refund, or compensation as set out in our Warranty Policy, regardless of anything in this Fair Use Policy.
